This Privacy Policy describes our practices in connection with personal data that we process through the Websites, through the Apps, through our social media, through communications that we send to you that link to this Privacy Policy, as well as through public sources, our relationships with affiliates, partners, service providers and other third parties and through your offline interactions with us where notice is legally required (collectively, including the Websites, Apps, social media, other sources and offline interactions, the “Services”).

This Privacy Policy does not apply to personal data processing activities for which we do not determine the purposes and/or the means because they are managed completely by one of our affiliates. In such cases, you will be informed about the processing of your personal data by the local entity responsible for the processing of your personal data. Who we are

Your personal data are processed by Samsonite Europe NV (“we”, “us”, “our”), having its registered offices at Westerring 17, 9700 Oudenaarde, Belgium and registered under enterprise number 0400.245.655 in the RPR/RPM Ghent, Oudenaarde division. If you wish to contact us, you are kindly requested to contact us at privacy@aboutbags.com. For security reasons we ask that you never include credit card or other sensitive information in the emails which you send to that email address. On the website https://www.aboutbags.com/ we present you with a user-friendly system to update your personal data, report a data breach and change certain data processing preferences.

The “Last Updated” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you accept the revised Privacy Policy.

Preliminary remarks

Minors

The Services are not directed to individuals under the age of sixteen (16), and we do not knowingly collect personal data from individuals under 16, except in those countries where the minimum age is lower.

Third party services

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates. Similarly, we will use a third-party payment service to process payments made through the Services. If you wish to make a payment through the Services, your personal data will be collected by such third party and not by us and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your personal data.

Without prejudice to what is stated below regarding use and disclosure in connection with social media providers, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Meta, Apple, Google, Microsoft, RIM, TikTok or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any personal data you disclose to other organizations through or in connection with the Apps or our social media.

We may, however, rely on the services of affiliate marketing service providers who will show our advertisements on other third-party websites. We exchange limited pseudonymized personal data with these affiliate marketing service providers to measure the effectiveness of our ads on such third-party websites. For such exchanges, we collect your consent through the cookie consent mechanism in our Privacy Center, where you can change your preferences at any time.

Sensitive data

We do not collect, and ask that you not send us nor disclose, any sensitive or special categories of personal data (for example, personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometrics or genetic characteristics, criminal background, data concerning health or data concerning a person's sex life or sexual orientation, or social security numbers) on or through the Services or otherwise to us.

General purposes for which we process your personal data

We will always process all personal data we have collected about you, as described further herein, for the following general purposes:

  • to comply with legal obligations incumbent upon us, which may include laws outside your country of residence;

  • to comply with any reasonable request or order from competent officials or representatives of the police, judicial authorities, government agencies or governmental bodies, including when they are located outside your jurisdiction, for which we rely on our legal obligations;

  • to transfer your personal data at our initiative to the police, judicial authorities or external counsel as evidence or in the event of reasonable suspicion of an illegal act or offence on your part when you use the Websites, Apps, our social media or any other interaction you have with, or in relation to, us, for which we rely on our legitimate interest to defend our interests;

  • to enforce, and have enforced, any of our applicable terms and conditions for which we rely on our legitimate interests to have our agreements enforced;

  • to be able to prepare and undertake corporate transactions such as mergers, acquisitions or demergers, for which we rely on our legitimate interest to engage in such transactions;

  • to protect, and have protected, our rights, privacy, safety or property and those of our affiliates, employees, contractors, you or third parties, for which we rely on our legitimate interests to be a responsible business partner, employer, supplier and member of society.

In principle, we will only retain your personal data in accordance with the retention periods set forth in the sections below, unless one of these general purposes warrants a longer retention period for the purpose to be achieved.

When you use our Websites, Apps or social media

When you just visit our Websites, Apps or social media

When you visit our Websites, Apps or social media, we will collect, depending on the functionalities and features you use:

  1. technical information related to the device you are using and your internet connection, such as your IP address, browser type, geographical location and operating system;

  2. information about the way you interact with the Websites, Apps or social media;

  3. information which is already stored on your device, such as your cookie preferences, unique identifiers, etc.;

  4. the physical location of your device.

All of the above personal data we receive directly from you as well as from our social media providers (when you visit our social media). When you visit us on social media, the social media provider is solely responsible for the collection of the information about your interactions with that social media platform which are not shared with us. When you visit our Websites, Apps or social media, we will collect your personal data to:

  • allow you to use these Websites, Apps and social media;

  • keep these Websites, Apps, social media as well as our company, assets, employees and other stakeholders safe and secure;

  • collect non-personalized statistical information about the manner in which people interact with the Websites, Apps, social media and their content.

For all of the above purposes, we base ourselves on our legitimate interest to process your personal data to be able to engage in normal business communications and communicate about our products, services and activities, to understand how our communication channels are used and to evolve as a business.

Your personal data, which are pseudonymized unless we can link these data to a registered user account, will be stored until such time you exercise a valid right to erasure. Please bear in mind that we will only erase personal data to the extent that we are still able to establish that these data pertain to you, in accordance with our legal obligations.

When we collect the physical location of your device when using our Websites or Apps, we do so to provide you with personalized location-based services and content. We also sometimes share your device’s physical location, combined with information about what advertisements you viewed and other information we collect, with our marketing partners to enable them to provide you with more personalized content and to study the effectiveness of advertising campaigns. In some instances, you may be permitted to allow or deny such uses and/or sharing of your device’s location, in which case we rely on your consent. In this case, your personal data will be stored until such time when you withdraw your consent, which you may do at any time. If you deny your consent, we and/or our marketing partners may not be able to provide you with the applicable personalized services and content.

Uses and Disclosures in connection with Meta, TikTok and Pinterest

We engage the services of Meta Platforms Ireland Ltd (“Meta”), TikTok Technology Limited (Ireland), TikTok Information Technologies UK Limited (UK) and Pinterest Europe Ltd. in our implementation of services such as the Meta, the TikTok and Pinterest Conversions API, Facebook and TikTok social plug-ins, the Facebook and TikTok Pixel and the Pinterest Tag. Via these services, we share information with Meta, TikTok and Pinterest to receive valuable insights on your use of the website and your interest in our products, e.g., to provide you with advertisements that better suit your interests, to provide us with analytics and statistics, and for the improvement of our website. We process the personal data we share with Meta, TikTok and Pinterest only based on your consent.

We act as joint controllers together with Meta, TikTok and Pinterest in accordance with Article 26 General Data Protection Regulation (GDPR) for the collection and processing of your personal data for the purposes indicated above. This is done via the Facebook and TikTok Pixel and the Pinterest Tag. We have the necessary agreements in place with Meta, TikTok and Pinterest to safeguard your personal data as required under the GDPR. Furthermore, Meta, TikTok or Pinterest may use your information as an independent controller to improve, provide and secure the Meta, the TikTok or the Pinterest products. For further information on the processing operations performed by Meta, TikTok and Pinterest and any rights you have as a data subject in relation to Meta, TikTok and Pinterest, please refer to their privacy policy mentioned above.

Please do consider that your information may be linked to your Facebook, TikTok or Pinterest account e.g., if you visit the Websites or Apps using Facebook, TikTok or Pinterest login or social plugins (see also When you create an account ).

When you create an account

When you create an account on our Websites or in one of our Apps, we will collect from you (in addition to the personal data mentioned in the previous section):

  1. basic identity information, such as gender and name;

  2. contact details such as email address, phone number and physical address;

  3. contact preferences related to our newsletters, commercial offers and promotions;

  4. order history;

  5. Any other personal data you choose to provide to us, such as your birthday.

We collect and use these personal data to:

  • allow you to create and manage an account on our Websites and Apps and enjoy the benefits and advantages which we may choose to make available to users with an account;

  • add your preferences related to receiving our newsletters, commercial offers and promotions to your user account so that we may keep track of them.

For these purposes, we base ourselves on our legitimate interest to offer our Website and App users a personalized experience through a dedicated user account when using our Websites and Apps and to be able to manage your preferences.

Your personal data will be stored for as long as your account is not deactivated. Once you decide to deactivate your account, we will render the account inaccessible, but all personal data associated with the account will be archived for a reasonable period after such deactivation and subsequently deleted.

When you choose to create or link your account using social media platforms, we may act as joint controllers with these social media providers for certain processing activities relating to your account creation. The personal data processed during the creation of an account will be processed as described above. We may receive and process:

  • Your social media account ID and profile information;

  • Basic profile data (name, email address, profile picture) as permitted by your social media privacy settings;

  • Any additional information you explicitly consent to share during the account linking process.

If you delete your social media account, your ability to access our services through that login method will be terminated. We recommend setting up alternative login credentials (email and password) to maintain account access.

When you buy online, request warranty or return or exercise a right of withdrawal

When you buy online, request warranty, return a product or exercise withdrawal rights as a consumer, we collect from you the following personal data (in addition to the personal data collected when you visit our Website or App, as explained above):

  1. basic identity information, such as gender and name;

  2. contact details such as email address, phone number and physical address;

  3. information related to your order, such as the products and services you bought;

  4. your acceptance of our terms and conditions and other contractual arrangements;

  5. information related to the chosen payment method.

We collect and use these personal data to:

  • allow you to purchase products and services on our Websites or Apps;

  • process orders, issuing invoices and handling transport;

  • allow you to submit warranty, return or withdrawal requests.

For these purposes, we will process your personal data because it is necessary to perform our contractual obligations towards you.

We will also process your personal data to:

  • obtain statistics about the products and services bought;

  • allow management reporting;

  • improve our retail processes;

  • improve our existing products and services or develop new products and services.

For these purposes, we base ourselves on our legitimate interests to collect customer feedback, gain insights in customer perception, collect information on market trends and evolve as a business.

Your personal data will be stored at the longest until each possible claim has been time-barred after your purchase, request for warranty, return or withdrawal.

When you have concluded a purchase for one of our products, we reserve the right to offer you one or more coupons or similar benefits which you can use to purchase products and services from third parties at a discounted price. The coupons are made available by Sovendus GmbH. When you choose to use a coupon, we will share pseudonymized personal data with Sovendus GmbH, such as your IP address, order value and coupon code, for which we rely on our legitimate interest to offer coupon services to our customers. We only share these personal data to let you use Sovendus’ coupon services. When you register your product

When you register your product through our Websites or Apps, we collect from you the following personal data (in addition to the personal data collected when you visit our Website or App, as explained above):

  1. basic identity information, such as your name;

  2. contact details, such as email address;

  3. your country of residence;

  4. contact preferences related to our newsletters, commercial offers and promotions;

  5. information related to the product you bought.

We collect and use these personal data to:

  • let you register your products;

  • offer you additional products and services in relation to the product you already bought;

  • let you manage your warranty;

  • obtain statistics about the products and services which are bought;

  • inform you of any updates about security issues or safety alerts related to your product.

For the first four purposes, we base ourselves on our legitimate interests to develop and offer additional or accessory products and services, gain insights in customer perception, collect information on market trends and evolve as a business.

For the last purpose, we base ourselves on the necessity of the processing to comply with our legal obligations.

Your personal data will be stored for as long as required to achieve the aforementioned purposes after the completion of the last registration of a product you have made.

When we communicate with you

When we communicate with you via phone, email, contact or after-sales forms, video calls, chat, text or direct messaging, we will collect from you:

  1. basic identity information, such as your name, e-mail address, phone number, postal address;

  2. the content of your communications;

  3. the technical information of your communications (the person with whom you communicate on our side, the date and time, other metadata about the communication, etc.)

  4. your preferences regarding the receipt of our e-mail communications, such as newsletters, commercial offers and promotions;

  5. any other personal data you choose to provide to us.

When you contact us

We collect and use these personal data to:

  • respond to your questions, queries or other communications;

  • keep our Websites, Apps, social media, company, employees, assets and information safe;

For all of the above purposes, we base ourselves on our legitimate interest to process your personal data to be able to engage in normal business communications, to understand how our communication channels are used and to evolve as a business.

Your personal data will be stored for as long as is necessary to respond to your queries. When such communications are of a transactional or contentious nature (i.e. they relate to a purchase, warranty, return, etc.), we will store them at the longest until each possible claim has been timebarred.

Newsletters, commercial offers, promotions

We collect and use your personal data, as well as other personal data we have collected about you in one of the circumstances mentioned above, to:

  • send you our newsletters, commercial offers, promotions;

  • personalize the content of these newsletters, commercial offers and promotions;

  • measure the effectiveness of our marketing efforts and campaigns and report on them.

We will always ask for your consent to:

(a) combine information we have about you to personalize content of newsletters, commercial offers and promotions;
(b) send you newsletters, commercial offers and promotions.

You can withdraw your consent at any time. We reserve the right to store your personal data until such time you withdraw your consent, and at the longest until all purposes for processing mentioned herein have been achieved. If you are an existing customer who has not provided consent, we base ourselves on our legitimate interests to send you marketing materials relating to similar products and services than those which you already procured from us. We retain your personal data at the longest until all purposes for processing mentioned herein have been achieved as well, unless you oppose the processing of your personal data for our marketing purposes.

We also have partnerships with third-party service providers who may send marketing materials relating to our products and services. These service providers are responsible for obtaining your consent for sending such marketing materials and they must inform you of their processing of your personal data before asking for your consent. When you leave a product review

When you leave a product review, we will collect the following personal data:

  1. basic identity information, such as your first name and email address (which will not be published);

  2. information about the product you bought as well as the timeframe between your purchase and the posting of your product review

  3. the content of your review.

We collect and use these personal data to:

  • invite you to leave a review;

  • engage in editorial control on reviews which you submit for publication;

  • let you publish a review anonymously or with your first name.

Any processing of personal data to be invited to submit and to submit and publish a product review is always based on our legitimate interest. Once you ask us to remove the product review, we will make our best efforts to remove your product review from the Websites to the extent that we can still identify which product review pertains to you. We will process your personal data associated with a product review for as long as you do not ask us to remove the review.

When you participate in an event or fair

When we organize it

When we invite you to participate to an event or a fair that we organize for which we would like to invite you to participate, we will collect from you:

  3. information related to your proof of identity, if required for travelling or participating to the event or fair;

  5. dietary preferences and food (in-)tolerances to the extent that food is served at the event or fair;

  6. any other information you share with us in relation to your registration for, or participation to, the event or fair.

We collect and use these personal data to:

  • invite you to our events or fairs;

  • organize your travel and participation to the event or fair;

  • make statistical analyses on our fairs and events;

  • improve our fairs and events.

For all of these purposes we base ourselves on our legitimate interests as a business to organize and host events or fairs. We will retain your personal data at the longest until all purposes for processing mentioned herein have been achieved after your registration for the event or fair.

We will also collect and use your personal data, with the exception of information related to your proof of identity or dietary preferences and food (in-)tolerances, to report about the event or fair on our Websites, Apps or social media or in printed media. We will always ask for your consent before we publish your personal data in an identifiable manner on our online or printed media channels. You can withdraw your consent at any time. Your personal data published on our online or printed media channels will be retained until you withdraw your consent. For printed media, your withdrawal of consent only relates to the publication of new printed materials but not those which have already been published.

When we are a participating organization

When we invite you to an event or fair to which we participate, we may collect from you or from the organizer of the fair or the event:

  • make statistical analyses on the fairs and events where we are present.

For all of these purposes we base ourselves on our legitimate interests as a business to participate in events or fairs and invite our business contacts. We will retain your personal data at the longest until all purposes for processing mentioned herein have been achieved after your registration for the event or fair.

We will also collect and use your personal data to report about our presence at the event or fair on our Websites, Apps or social media or in printed media. We will always ask for your consent before we publish your personal data in an identifiable manner on our online or printed media channels. You can withdraw your consent at any time. Your personal data published on our online or printed media channels will be retained until you withdraw your consent. For printed media, your withdrawal of consent only relates to the publication of new printed materials but not those which have already been published.

When you visit one of our stores

In case of a simple visit

When you visit one of our stores, we will collect from you in specific circumstance:

  1. basic identity information, such as your name;

  2. your presence in the store;

  3. any other information you provide to us.

We collect and use these personal data to:

  • ensure the safety and security of anyone who visits our store, our staff, our products and our premises;

  • collect aggregated statistics on how people visit our stores.

For all of these purposes we base ourselves on our legitimate interests to ensure a safe and commercially optimal shopping environment in our stores.

Your personal data will only be retained in a non-identifiable manner, unless there are indications that you were involved in an incident in one of our stores, in which case your personal data may be stored for as long as required to defend our interests.

In case of the creation of an account in-store

When we register you in one of our stores, we will collect from you or through the intervention of one of our shopping assistants:

  1. basic identity information, such as gender and name;

  2. contact details such as email address, phone number and physical address;

  3. contact preferences related to our newsletters, commercial offers and promotions;

  4. your signature.

We collect and use these personal data to:

  • let you register as a customer;

  • register your preferences related to our newsletters, commercial offers and promotions.

For all of these purposes we base ourselves on our legitimate interests to create a customer database of people who visit our stores. Your personal data will be stored at the longest until all purposes for processing mentioned herein have been achieved unless you request us to delete them before such time and such request for deletion is valid. We request your consent for using the collected personal data to send you newsletters, commercial offers and promotions. You can withdraw your consent at any time.

When you make a purchase or request warranty, return or repair

When you make a purchase in one of our stores, request warranty or return a product as a consumer, we will collect from you the following personal data:

  1. basic identity information, such as gender and name;

  2. contact details such as email address, phone number and physical address;

  3. information related to your order, such as the products and services you buy;

  4. information related to the chosen payment method.

We collect and use these personal data to:

  • let you purchase products and services in one of our stores;

  • process orders, issuing invoices and handling transport (only when we agree to provide such transport services upon your request);

  • let you submit warranty, return or repair requests.

For these purposes, we will process your personal data based on the necessity to perform our contractual obligations towards you.

We will also process your personal data to:

  • obtain statistics about the products and services which are bought;

  • management reporting;

  • improve our retail processes;

  • improve our existing products and services or develop new products and services.

For these purposes, we base ourselves on our legitimate interests to collect customer feedback, gain insights in customer perception, collect information on market trends and evolve as a business.

When you place an order with a store via phone, we will send you an email with a payment link. We rely on the necessity of using your email address to perform our contract with you. The payment service itself is offered by a third-party payment service provider.

Your personal data will be stored at the longest until all possible claims have been time-barred after your purchase, request for warranty, return or repair.

When you visit our company premises (apart from stores)

When you visit our company premises at Samsonite Europe NV, we will collect from you:

  1. basic identity information, such as gender and name;

  2. contact details such as email address and phone;

  3. professional information, such as the company you work for and your role;

  4. information about the time you enter our buildings and the person on our end with whom you have a meeting;

  5. information about your location;

  6. your license plate;

  7. your signature;

  8. your image recorded through our CCTV system.

We collect and use these personal data to:

  • to protect our staff, other visitors, our assets, premises and interests;

  • to prevent theft, vandalism and other types of crime;

  • for safety reasons in the context of, for example, a fire or an evacuation;

  • to inform persons with whom you have a meeting that you arrived.

For these purposes, we base ourselves on our legitimate interests to protect our staff, business and interest and to organize ourselves practically.

Your personal data will be stored for a maximum of one (1) year after your visit. The images collected via our CCTV system are erased after one (1) month.

When you participate in one of our surveys, sweepstakes or competitions

When you participate in a survey, sweepstake or competition, we will collect from you:

  1. basic identity information, such as gender and name;

  2. contact details such as email address and phone;

  3. your purchase history;

  4. any answers or input you provide to the survey, sweepstake or competition.

We collect and use these personal data to:

  • let you participate to the survey, sweepstake or competition;

  • inform you of the results of a sweepstake or competition;

  • obtain statistics and insights related to your participation in the survey, sweepstake or competition;

  • avoid and detect fraud, malicious, harmful or otherwise illegal conduct;

  • improve our products, services or business processes or develop new products or services.

For these purposes, we base ourselves on our legitimate interests to organize such sweepstakes or competitions as a business, to ensure that they are held fairly and safely and to improve our business.

Please note that a separate privacy clause may also be added in the terms and conditions of such a survey, sweepstake or competition, which will complement this Privacy Policy.

Your personal data will be stored at the longest until all purposes for processing mentioned herein have been achieved after your participation to the survey, sweepstake or competition.

When you are one of our suppliers or a prospective supplier or represents one of them

In addition to any interactions we may have with you as a consequence of your use of our Websites, Apps, social media or communication via e-mail, phone, video calls, chat, text or direct messaging, we collect, from you directly or from the company you work for, whenever we receive a quotation for goods or services or order those goods or services from you:

  1. your basic identity information such as name, e-mail address, postal address, telephone number, company you work for, your position;

  2. the content of your communications, and the technical information of your communications themselves (the person with whom we communicate on our side, the date and time, etc.);

  3. payment and invoice related data when you invoice us for your goods or services.

We process your personal data in order to:

  • get a quotation for goods or services from you;

  • compare your offer to similar offers in the market

  • process the order, receive the order from you and handle invoicing and quality management;

  • engage in normal supplier relationship management;

  • engage in normal internal management reporting activities.

For the first three purposes we process your personal data because it is necessary to come to an agreement with you and perform the said agreement. If you represent a company, we rely on our legitimate interest to process the contact details of the people who represent our suppliers.

For the other two purposes the processing is based on our legitimate interest to engage in normal business and supplier follow-up.

Recipients of your personal data

We disclose personal data:

  • to our affiliates for the purposes described in this Privacy Policy.

    • You can consult the list and location of our affiliates at http://www.aboutbags.com. Affiliates as used in this document mean the entities controlled by, under common control with or controlling us.

  • to our third-party service providers, to facilitate services they provide to us.
